Protecting Your Rights
New! June 2007 Verdict: Allstate
offers $8,000, Jury awards $122,500
Personal Injury: Motorhome backs into plaintiff causing a partial tear of his meniscus.
Details: A jury in Santa Cruz County awarded Caputo's client $122,500 in a case where
Allstate offered $8,000 and never once moved from its initial offer in the
case (total judgment after costs and interest will be over $150k).
It took the Jury just 40 minutes to conclude that Allstate was
trying to evade personal responsibility in the case by arguing
that the knee injury that required surgery was more than just
"a bruise and a pre-existing condition".
Verdict: $2,165,000
Personal Injury: Disabled person suffered a non-operable rotator cuff tear and broken shoulder.
Details: In representing a disabled wheelchair rider injured by the
negligence of the Valley Transportation Agency, Caputo
challenged the wheelchair securement policy of the transit
agency and won critical lifetime medical care for his client. The verdict led to a change in the policy that
resulted in the injury of hundreds of disabled wheelchair
riders. It improved safety for all passengers riding transit
buses and will save taxpayers millions of
dollars.
Verdict: $1,050,000.00
Personal Injury: Partial amputation of foot
Details: Intersection collision.
Verdict $225,000.00
Personal Injury: Toxic Exposure
Details: As a company with a large employment base and
favorable image in that area, Foster Farms offered a Caputo
client zero dollars in a case that involved a laborer
developing respiratory complications following exposure to
anhydrous ammonia fumes that leaked from a Foster Farms
facility. Following nearly three years of unsuccessful
negotiations, tens of thousands of dollars spent on behalf of
the client, Caputo took the case before a jury in Stanislaus
County and received a verdict totaling $225,000. “When you
represent clients that are clearly injured by someone’s
negligence, juries are capable of awarding damages that are
equitable and just despite the favorable image of a
company”, states Caputo.
Verdict: $300,000.00
Injury: Wrongful Termination/Breach of Contract
Details: Insurance salesman was wrongfully terminated from his employment.
Settlement: $5,825,000.00
Personal Injury: Quadriplegia
Details: Following a rear-end auto accident, an office
administrator brought an action against an auto
manufacturer alleging that her injuries were caused
largely because the seat installed in her car was
defective.
Settlement: $1,130,000.00
Personal Injury: Reflex Sympathetic Dystrophy (RSD)
Details: Clerical worker suffered RSD following a rear-end
auto accident.
Settlement: $1,030,000.00
Injury: Wrongful Death
Details: Action for the wrongful death of a truck driver.
